These Terms and Conditions apply to the use of the facilities and services provided by Kangaroos in the Top Paddock by its customers and guests.

Bookings and Reservations
Customers may make reservations in advance through the online booking request form located on this website or by telephoning Robin on +61 427 665 089. When making reservations, Customers may be required to provide identification information including, but not limited to, their name, address, contact telephone number and email address.
Payment will be required for all reservations. Unless the reservation is expressly stated to require payment at the time of reservation, no payment will be taken until such times as the reservation is confirmed.
Reservations booked in advance do not constitute a legally binding contract between Kangaroos in the Top Paddock and the Customer until Kangaroos in the Top Paddock confirms the reservation either by phone or online confirmation with the Customer and provides the Customer with a booking reference and payment account details.
Reservations may be changed by the Customer at any time prior to arrival (subject to the cancellation terms). Kangaroos in the Top Paddock will use all reasonable endeavours to accommodate any changes requested but gives no guarantee that all changes will be accommodated.
Customers may also request additional nights at Kangaroos in the Top Paddock at any time during their stay. Kangaroos in the Top Paddock will use all reasonable endeavours to accommodate such requests.

Fees and Payments
Details of Rates including, where applicable, promotional Rates based on room type and other special offers are available from the following link. Rates and prices quoted apply only to accommodation unless otherwise stated. Additional charges may apply for items including, but not limited to any other extras. Customers shall pay all sums due prior to checking-in Kangaroos in the Top Paddock. Payment shall be against an invoice and must be made immediately, subject to any alternative agreement between Kangaroos in the Top Paddock and the Customer.
Kangaroos in the Top Paddock may from time to time offer promotional Rates. The following provisions apply: Unless expressly stated otherwise, all reservations to which promotional Rates apply must be paid in full at the time of booking; Additional charges incurred by the Customer during their stay will be invoiced and payable in accordance and Additional nights requested and shall be charged at the promotional Rate or the standard Rate depending on the offer. Advance payments made are non-refundable. Any deposits or booking fees taken at the time of reservation are non–refundable.

Payment Methods
The following payment methods are accepted by Kangaroos in the Top Paddock.
Direct bank deposit EFT Credit Card (MasterCard and VISA only)

Cancellations
Reservations may be cancelled without charge provided the Customer gives at least 30 days’ notice. If a cancellation is made without 30 days’ notice then a 50% cancellation fee will apply to the booking. Cancellation Less than 14 days will mean the full deposit is held. Kangaroos in the Top Paddock may, from time to time, cancel a reservation. In the event of such cancellation, the Customer shall be informed immediately and shall be offered alternative accommodation of the same standard or better or a full refund of any and all sums paid.

Check-in and Check-out
Check-in time at by Kangaroos in the Top Paddock is after 3pm. Check-in before 3pm may be permitted under special circumstances and only after express consent is given depending on the circumstances. Check-out time is 10:30am. Later check-out times may be possible by prior arrangement, however in the absence of such prior arrangement, failure to check-out by 10:30am may result in the Customer being charged for an additional late checkout fee.

House Rules
Guests are required to conduct themselves in a reasonable and responsible manner at all times when on the Kangaroos in the Top Paddock property and must not act in any which may disturb any neighbours or passes by. Failure to adhere to this requirement may result in a Customer being asked to leave Kangaroos in the Top Paddock in which event all sums due shall become immediately payable.
Smoking is not permitted in any indoor or outdoor areas of Kangaroos in the Top Paddock. Failure to adhere to the requirements shall result in the Customer being charged for any and all costs incurred by Kangaroos in the Top Paddock in cleaning rooms (including, but not limited to, fixtures, fittings and soft furnishings) and restoring it to a smoke-free environment.
Animals are not allowed at Kangaroos in the Top Paddock.
Children under the age of 16 may not stay at Kangaroos in the Top Paddock.
Customers shall be charged for any and all damage caused by them to Kangaroos in the Top Paddock property during their stay.

Limitation of Liability
To the fullest extent permissible by law, Kangaroos in the Top Paddocks liability for any loss or damage suffered by Customers shall be limited to that which arises out of the negligence of Kangaroos in the Top Paddocks employees, subcontractors or agents. Notwithstanding above, Kangaroos in the Top Paddock shall not be liable for any indirect loss or damage which may be suffered by a Customer including, but not limited to, loss of income, loss of business, loss of profits, loss of opportunity, loss of anticipated savings, loss of data or loss of enjoyment. Nothing in these Terms and Conditions purports to limit or exclude Kangaroos in the Top Paddocks liability for: death or personal injury cased by the negligence Kangaroos in the Top Paddock, its employees, subcontractors or agents; fraud or fraudulent misrepresentation; or any other matter for which it would be illegal for Kangaroos in the Top Paddock to limit or exclude its liability.

General
The Customer’s rights as a consumer under consumer protection legislation from time to time in force shall not be affected by these Terms and Conditions. Kangaroos in the Top Paddock may, from time to time, change these Terms and Conditions without notice, however it will use its reasonable endeavours to inform Customers as soon as is reasonably possible of any such changes.

No Waiver
No failure by Kangaroos in the Top Paddock to enforce any provision in these Terms and Conditions shall constitute a waiver of the right to subsequently enforce that provision or any other provision of these Terms and Conditions. Such failure shall not be deemed to be a waiver of any preceding or subsequent breach and shall not constitute a continuing waiver.

Severance
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.

Law and Jurisdiction
These Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of Australia. Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of Australia.
